Definition

Access to the right-of-way involves any interruption of the boundary fence of the right-of-way and can be classified as commercial, private, or public accesses.

In summary, access is any road that connects to the highway, allowing the entry or exit of vehicles to areas adjacent to the right-of-way. 

The prerogative for the approval and granting of access to the right-of-way is the exclusive competence of the Granting Authority, with the Concessionaire being responsible only for guiding, instructing, and facilitating the process for submission of the analysis to the Regulatory Agency. This is done by complying with the Current Regulations and Laws mentioned below that govern the subject, following the flow and phases of the internal process as outlined below.

Process Phases

The process of submitting projects and documents for the analysis of the feasibility of opening and/or regularizing access can be divided into the following major stages:

Functional Project

Presentation of legal documentation aiming to prove ownership of the property and the applicant's commitment to the process of opening/regulating access and compliance with current regulations. The Functional Project, containing all its studies supporting the proposed technical solution in the right-of-way, must also be presented.

Executive Project

If the Functional Project is considered technically viable, it progresses to the detailed Executive Project phase, which will be analyzed and evaluated by the Concessionaire before being submitted for final approval by the Granting Authority.

Construction Phase

After the approval of the Executive Project by the Regulatory Agency, the process of instructing the Concessionaire for the start of implementation/restructuring works begins. The Concessionaire will oversee the progress of the works until their final completion.
